Implementing strategies for compliance under the Sexual Harassment of Women (Prevention, Prohibition and Redressal) Act 2013 (POSH) not only ensures legal adherence but also cultivates an environment where all individuals feel respected, valued, and protected. As an employer it is one’s duty to establish clear policies and procedures for one’s organisation to be POSH compliant. Accordingly, develop a comprehensive POSH policy that outlines prohibited behaviors, reporting mechanisms, and disciplinary actions and ensure that all employees receive thorough training on POSH policies and procedures, including awareness sessions and interactive workshops. These regular POSH awareness campaigns must aim to educate employees on their rights and responsibilities, and the procedures that are involved before and after a complaint is filed. It is also essential to provide orientation sessions for the Internal Complaints Committee at least once a year; and also training sessions for managers and supervisors on recognizing and addressing signs of harassment, as well as their role in fostering a safe work environment.
One of the prominent strategies is to encourage reporting. An organisation must implement confidential reporting mechanisms, such as anonymous hotlines or online platforms, to encourage employees to report incidents of harassment without fear of retaliation. Foster a culture of zero tolerance for harassment from the top down, with leadership actively promoting respect, inclusivity, and accountability.Â
Finally, it is vital that the management sees to it that regular monitoring and review is conducted in the organisation. Only if regular audits and assessments are conducted to evaluate the effectiveness of POSH compliance measures and identify areas for improvement, will its implementation be a success. Similarly, a method to solicit feedback from employees through surveys or focus groups to gauge perceptions of workplace safety and address any concerns proactively could be a very effective measure. Because employees make up the organisation and their concerns and feedback are crucial to understand where the flaw lies and what needs to be bettered.
